About this Policy

This Privacy and Cookie Policy explains how New Earth Era Inc., doing business as Frequency Gardening™, collects, uses, stores, processes, protects, and discloses personal information.

It applies when you visit a Frequency Gardening website or landing page; complete a form or checkout; purchase or access a product or program; download a free resource; join a mailing list or Community; attend a call or event; communicate with us; use FrequencyGardening.AI; participate in the Frequency Gardening Certification; interact with our social-media channels; or otherwise use an Offering that links to this Policy.

Please read this Policy before submitting personal information. By using our Sites or Offerings, you acknowledge the practices described here. Where consent is required by law, we will request it separately or through an appropriate form, checkbox, cookie banner, preference tool, agreement, or other consent mechanism.

Throughout this Policy, “Frequency Gardening,” “Company,” “we,” “us,” and “our” mean New Earth Era Inc., doing business as Frequency Gardening™. “You,” “your,” “user,” “customer,” “participant,” and “Candidate” mean the individual whose personal information is collected or processed.

2Scope of This Policy

This Policy applies to all Frequency Gardening websites, subdomains, sales pages, checkout pages, Kajabi portals, Communities, forms, email systems, SMS communications, digital programs, Certification services, AI Services, live and recorded calls, and other online properties that link to it.

It covers current and future Offerings including the Frequency Gardening Certification, Awakening Through the Garden, Full-Spectrum Electroculture, standalone courses, masterclasses, audio tracks, video programs, downloads, free resources, memberships, private calls, FrequencyGardening.AI, and related services.

This Policy does not automatically apply to another brand operated by New Earth Era Inc. unless that brand or Offering links to this Policy.

Third-party websites, social platforms, payment processors, and applications have their own privacy policies. Their handling of personal information is governed by their policies in addition to any responsibilities we retain under applicable law.

3What Personal Information Means

“Personal information” means information about an identifiable individual. It may include information that identifies you directly, such as your name or email address, and information that may identify you when combined with other data, such as an IP address, device identifier, purchase history, course activity, or social-media handle.

Personal information generally does not include anonymous information that cannot reasonably be connected with an identifiable individual or ordinary business contact information used solely to communicate with a person in their professional capacity, where excluded by applicable law.

4Our Privacy Principles

We seek to collect, use, and disclose personal information only for purposes that a reasonable person would consider appropriate in the circumstances. We limit collection to information reasonably needed for our stated purposes, use reasonable safeguards, provide access and correction rights where required, retain information only as reasonably necessary, and obtain consent where consent is required.

Depending on the applicable law and context, we process personal information based on consent, performance of a contract, steps requested before entering a contract, compliance with legal obligations, protection of rights and safety, or legitimate business interests that are not overridden by applicable individual rights.

You may withdraw consent to certain processing, subject to legal, contractual, fraud-prevention, recordkeeping, and operational restrictions. Withdrawing consent may affect our ability to provide an Offering.

5Information You Provide Directly

We may collect information you provide when you complete a form, make a purchase, create an Account, register for a masterclass, download a resource, join a Community, attend a call, submit work, contact support, participate in a survey, communicate through social media, apply for Certification, or otherwise interact with us.

This information may include your full name, commonly used name, email address, telephone number, billing or mailing address, country, time zone, social-media handle, business information, professional background, garden or property information, communication preferences, and account credentials.

We may also collect the questions, comments, messages, photographs, videos, audio, documents, garden designs, land observations, assignments, assessments, testimonials, feedback, surveys, chat messages, call contributions, and other content you choose to provide.

6Account, Program, and Course Information

When you create an Account or participate in an Offering, we may collect account identifiers, login history, program enrollment, purchase status, lesson and video progress, downloads, attendance, completion information, assessment status, submissions, support history, Community activity, and records of your interactions with Content.

We use this information to deliver the Offering, maintain access, provide support, measure engagement, administer programs, confirm delivery, improve Content, prevent account sharing, protect intellectual property, respond to payment disputes, and maintain business records.

7Transaction and Payment Information

When you make a purchase, our payment processors may collect your payment-card number, bank information, billing details, PayPal information, financing application information, or other payment credentials.

We generally receive transaction information such as your name, email address, billing address, transaction amount, currency, payment status, payment method, processor reference, installment schedule, refunds, disputes, and limited card details such as the brand and final digits. We do not need or intend to store complete card numbers or security codes on our own ordinary business systems.

Payment information may be processed by Kajabi Payments, Stripe, PayPal, banks, financing providers, or another payment processor used for the transaction. Their privacy and security practices are governed by their own policies.

We use transaction information to process purchases, administer Payment Plans and Subscriptions, issue receipts, calculate taxes, prevent fraud, reconcile accounts, collect overdue amounts, respond to chargebacks, and meet accounting and legal obligations.

8Crypto-Asset Transactions

If you request and receive approval to pay using a crypto-asset, we may collect your name, email address, invoice information, wallet address, transaction hash, blockchain network, asset type, amount, exchange-rate information, transaction timestamp, confirmation status, and related communications.

Where reasonably necessary, we may also request identity, location, wallet-control, source-of-funds, sanctions-screening, tax, fraud-prevention, or compliance information.

Blockchain transactions may be publicly visible and permanent. Information recorded on a public blockchain may not be capable of being changed or deleted by us.

9Frequency Gardening Certification Information

Certification Candidates may provide additional information including their full verifiable name, contact information, photograph, professional background, Certification submissions, garden or property information, observations, designs, assessments, client or land permissions, AI-use disclosures, call participation, Community activity, and information relevant to Certification eligibility.

We may collect information concerning assessment decisions, corrections, certification status, good standing, complaints, Code of Ethics concerns, investigations, warnings, suspensions, revocations, appeals, and use of the Certified Frequency Gardener title and mark.

We may request government-issued identification or another form of identity confirmation where reasonably necessary to verify identity, prevent fraud, investigate misconduct, protect the Certification mark, or comply with law. We do not intend to collect government identification routinely when a less intrusive form of verification is sufficient.

Certification records may be retained for an extended period where reasonably necessary to confirm whether a person was certified, verify current good standing, protect the Certification mark, investigate complaints, maintain assessment integrity, or establish historical records.

Where a Certified Frequency Gardener publicly uses the Certification title or mark, we may confirm limited Certification-status information, such as whether the person is currently certified or in good standing, where reasonably necessary and legally permitted.

10Recordings, Transcripts, Chats, and AI Notes

Teaching calls, workshops, question-and-answer calls, Community calls, support calls, Certification calls, private calls, onboarding sessions, and other online meetings may be audio recorded, video recorded, transcribed, summarized, or processed through AI tools.

Recordings may include your name, display name, profile image, face, voice, video background, chat messages, questions, reactions, screen sharing, and information you voluntarily discuss.

Group recordings, transcripts, and summaries may be made available to authorized participants inside a Program portal. Private-call recordings and notes are used internally for service delivery, support, training, quality assurance, safety, legal compliance, recordkeeping, and dispute resolution unless separate consent is obtained for broader use.

Recordings and transcripts may be stored both on our own business systems and through Kajabi, Zoom, cloud-storage providers, transcription services, AI providers, or other authorized service providers.

You may generally participate with your camera off unless visual participation is reasonably required for identity verification, assessment, or a specifically disclosed activity.

11Sensitive Information

Participants sometimes voluntarily discuss health, emotional experiences, spiritual or intuitive experiences, personal circumstances, animals, land locations, or other potentially sensitive matters.

Please do not send or upload medical records, diagnostic records, government identification numbers, passwords, payment credentials, confidential client records, or unnecessary sensitive information through ordinary email, Communities, forms, calls, or AI Services.

If you voluntarily disclose sensitive information, we may process it only as reasonably necessary for the purpose for which you provided it, to administer the relevant Offering, protect safety, respond to a concern, or comply with law.

You should share carefully in group environments. Although participants are required to respect confidentiality, we cannot guarantee that another participant will not repeat or misuse information shared during a group call or in a Community.

12Information Collected Automatically

When you visit a Site or use an Account, we and our service providers may automatically collect technical and usage information. This may include your IP address, general geographic region, browser type, device type, operating system, language, time zone, referring page, pages viewed, links clicked, date and time of access, session duration, login history, advertising identifiers, cookie identifiers, purchase attribution, course activity, and interactions with emails or advertisements.

We use this information to operate Sites, authenticate users, remember preferences, understand audience activity, improve Offerings, prevent fraud, protect security, measure advertising, attribute referrals, analyze sales, and respond to disputes.

13Cookies and Similar Technologies

Cookies are small files or identifiers stored on or accessed through a browser or device. We may also use pixels, tags, software development kits, local storage, scripts, web beacons, and similar technologies.

Strictly necessary cookies support security, checkout, account login, payment processing, fraud prevention, load balancing, and essential Site functions. These technologies may operate without optional consent where permitted by law because the requested service cannot function properly without them.

Functional cookies remember preferences and improve features. Analytics cookies help us understand Site traffic, page performance, email engagement, and how users interact with Offerings. Advertising cookies and pixels help us measure campaigns, build audiences, limit repeated advertising, attribute conversions, and deliver or evaluate interest-based advertising. Affiliate and referral technologies identify the source of a visit or purchase so that referrals and commissions can be tracked.

We currently use or may use Kajabi analytics, Google Analytics, Google Ads conversion tracking, Meta Pixel and related Facebook or Instagram advertising tools, TikTok Pixel, YouTube and Vimeo embedded media, Zoom, Google reCAPTCHA, email tracking, affiliate tracking, referral links, and similar services.

These providers may collect online identifiers, device information, browsing activity, referral information, interaction data, and advertising information according to their own policies.

14Cookie Choices and Consent

Where required by applicable law, we will request consent before activating non-essential analytics, advertising, or tracking technologies. We may use a cookie banner, preference centre, regional settings, or another consent tool to provide choices.

Where a preference tool is available, you may accept all cookies, reject non-essential cookies, or select categories. Withdrawing consent does not affect processing that occurred lawfully before withdrawal.

You may also use browser controls to block or delete cookies. Blocking cookies may prevent logins, checkouts, videos, saved preferences, or other Site features from working correctly.

Some browsers provide Global Privacy Control or another legally recognized opt-out preference signal. Where we are legally required and technically able to recognize such a signal, we will process it as required by applicable law.

We do not currently guarantee that every browser “Do Not Track” signal will be recognized because there is no universally applied technical standard for every such signal.

15Analytics and Advertising

We use analytics to understand website and program activity, determine how visitors find us, improve user experience, evaluate Content, and measure marketing performance.

We may use advertising services provided by Google, Meta, TikTok, and other platforms to create audiences, measure conversions, understand advertising performance, and display advertisements to people who may be interested in Frequency Gardening.

Advertising providers may connect information collected through our Sites with information they already hold about their users, subject to their own policies and your settings with those platforms.

You may adjust advertising preferences through our cookie tool where available, your browser settings, and the privacy or advertising controls provided by Google, Meta, TikTok, and other platforms.

16Affiliate and Referral Tracking

We may use referral links, affiliate codes, cookies, and similar identifiers to determine whether a customer arrived through a referring person or partner and whether a commission or referral payment is payable.

We may share limited information with a referring affiliate or partner where reasonably necessary to administer the referral relationship, such as confirmation that a qualifying purchase occurred, the commission amount, refund status, or an anonymized transaction reference.

We do not provide our entire customer or subscriber list to affiliates for their independent marketing merely because they referred a customer.

If we conduct a joint promotion, partner campaign, co-registration arrangement, affiliate list-sharing promotion, or another arrangement in which a partner will receive your contact information for its own marketing, we will disclose that arrangement at the point of collection and obtain any consent required by law.

17Social Media and Third-Party Channels

Frequency Gardening may operate accounts, channels, groups, or profiles through TikTok, Instagram, Facebook, YouTube, Substack, Vimeo, Pinterest, Telegram, and other social platforms.

When you follow, comment, message, subscribe, share, react, join a group, or otherwise interact with us through a third-party platform, we may receive your name, profile information, username, public posts, messages, comments, engagement information, and analytics supplied by that platform.

The platform separately collects and processes information under its own privacy policy. Your use of a platform, including direct messaging or membership in a Telegram or social-media group, is also subject to that platform's terms and settings.

Information posted publicly on social media may be visible, copied, indexed, or shared by others. Do not post confidential or sensitive information publicly.

18Email and SMS Communications

We may collect your email address or telephone number through purchases, registrations, free resources, waitlists, applications, events, Communities, forms, contests, referrals, or direct requests.

We may send transactional communications relating to purchases, accounts, security, billing, Program delivery, calls, Certification, support, legal notices, and service changes.

Where permitted by law, we may also send marketing emails and SMS messages about Content, offers, events, programs, or promotions when we have consent or another lawful basis.

Marketing messages will identify the sender and provide an unsubscribe or opt-out method where required. You may unsubscribe from email marketing through the link in the message. You may opt out of SMS marketing by replying STOP or using another method stated in the message. Message and data rates may apply.

We may retain a limited suppression record after an unsubscribe so that we can honour the request and avoid accidentally adding the address or number back to active marketing.

Unsubscribing from marketing does not stop transactional, security, billing, contract, Program, Certification, or other non-promotional messages that are reasonably necessary.

19FrequencyGardening.AI and Other Artificial Intelligence

FrequencyGardening.AI is a customized GPT hosted through ChatGPT and OpenAI or another identified AI platform. We may also use AI or automated services to support transcription, summarization, customer support, curriculum administration, assessment organization, Community moderation, fraud detection, marketing analysis, and internal operations.

Information submitted to an AI Service may be transmitted to and processed by the relevant provider. Do not submit passwords, payment credentials, government identifiers, medical records, confidential client information, trade secrets, or information you do not have authority to disclose.

We may use de-identified or aggregated questions, usage patterns, and educational themes to improve our Content, support systems, curriculum, and FrequencyGardening.AI. We will not publicly use an identifiable personal story, submission, testimonial, photograph, voice, or case study without separate permission.

AI may assist us in organizing, summarizing, comparing, or flagging Certification submissions and communications. AI will not be the sole method used to make a final Certification, suspension, or revocation decision.

AI systems may produce inaccurate or unexpected output. Information submitted to third-party AI platforms is also subject to those providers' privacy terms and security practices.

20How We Use Personal Information

We may use personal information to operate and secure our Sites; respond to inquiries; create and administer Accounts; process Orders, payments, Payment Plans, Subscriptions, crypto transactions, and refunds; deliver Digital Products and Programs; provide calls, Communities, support, and AI Services; manage the Certification; assess submissions; verify identity; maintain good-standing records; administer the Code of Ethics; schedule and record calls; provide transcripts and summaries; send transactional and marketing communications; personalize Content; measure engagement; conduct analytics; advertise and attribute campaigns; administer affiliates and referrals; prevent fraud and account sharing; respond to chargebacks; enforce agreements and intellectual property; investigate complaints; protect users and the public; comply with tax, accounting, legal, and regulatory duties; resolve disputes; and improve our Offerings.

We may also use information for another purpose that is compatible with the purpose for which it was collected, where permitted by law, or for a new purpose with additional notice or consent where required.

21When We Disclose Personal Information

We may disclose personal information to service providers that help us operate our business, including Kajabi, payment processors, banks, financing providers, crypto-payment or wallet services, cloud-storage providers, email and SMS providers, Zoom and other video platforms, Community providers, OpenAI and other AI providers, transcription services, analytics providers, advertising platforms, affiliate-tracking systems, fraud-prevention services, e-signature providers, website hosts, security providers, customer-support tools, accountants, insurers, lawyers, and other professional advisers.

Service providers may process information only for the contracted services or as otherwise permitted under their own direct relationship with you and applicable law.

We may disclose information to law enforcement, courts, regulators, tax authorities, government bodies, payment networks, banks, or other parties where we reasonably believe disclosure is required or permitted by law, necessary to protect rights or safety, needed to investigate fraud or unlawful conduct, or relevant to a claim, payment dispute, complaint, or legal proceeding.

We may disclose information in connection with a proposed or completed merger, financing, reorganization, sale, transfer, insolvency, or acquisition of all or part of our business, subject to appropriate confidentiality and legal requirements.

We may disclose information when you direct us to do so or provide consent.

22Payment Disputes and Fraud Prevention

If you initiate a chargeback, payment reversal, PayPal claim, financing dispute, or similar process, we may disclose relevant information to the bank, card issuer, payment network, processor, financing provider, insurer, collection provider, legal adviser, regulator, or dispute administrator.

Relevant information may include your purchase record, sales-page disclosures, receipt, signed agreement, identity and billing information, IP address, device data, login history, lesson and video progress, downloads, attendance, Community activity, submissions, support messages, call records, recordings, transcripts, and evidence of delivery or use.

We limit the disclosure to information reasonably relevant to verifying the transaction, responding to the claim, preventing fraud, or protecting legal rights.

23Sale, Rental, and Sharing of Personal Information

We do not sell or rent customer contact lists or personal information to data brokers or advertisers for money.

We may disclose online identifiers and browsing or advertising information to Google, Meta, TikTok, and similar providers for analytics, conversion measurement, audience creation, and interest-based advertising. Some privacy laws may define certain advertising-related disclosures as a “sale,” “sharing,” or targeted advertising even when no money is paid for the information.

Where such laws apply, you may have the right to opt out through our cookie preference tool, a legally recognized browser signal, or by contacting us.

We may share limited information with affiliates, referral partners, or joint-promotion partners as described in this Policy. We will request additional consent where required before providing contact details to another party for that party's independent marketing.

24International Processing and Transfers

We are located in British Columbia, Canada, but our service providers may process or store personal information in Canada, the United States, the United Kingdom, the European Economic Area, or other countries.

When personal information is transferred outside your province or country, it may be subject to the laws and lawful-access processes of the destination jurisdiction.

We take reasonable steps to select service providers and contractual arrangements appropriate to the nature of the information and the services provided. However, no international transfer or third-party system can be guaranteed to be free from legal access or security risk.

25Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, to provide Offerings, maintain business and Certification records, meet contractual obligations, resolve disputes, prevent fraud, enforce agreements, and comply with legal, tax, accounting, insurance, and regulatory obligations.

Account and course information may be retained while an Account remains active and for a reasonable period afterward. Transaction, tax, contract, chargeback, fraud, and accounting records may be retained for the legally or operationally required period.

Certification, assessment, good-standing, mark-use, complaint, and disciplinary records may be retained for as long as reasonably necessary to confirm Certification status, protect the Certification mark, preserve assessment integrity, and respond to future inquiries or disputes.

Marketing information may be retained until you unsubscribe, withdraw consent, or request deletion, subject to a limited suppression record.

Call recordings, transcripts, AI notes, support communications, and submissions may be retained for as long as reasonably necessary for delivery, administration, training, assessment, safety, quality assurance, dispute handling, and legitimate business records.

When personal information is no longer reasonably needed, we may delete, anonymize, aggregate, or securely destroy it. Residual copies may remain temporarily in backups, system logs, archives, or legally protected records until they are overwritten or eligible for deletion.

26Security Safeguards

We use reasonable administrative, technical, organizational, and physical safeguards appropriate to the sensitivity and volume of the information we handle.

Safeguards may include restricted access, passwords, multifactor authentication where available, encrypted connections, service-provider reviews, access controls, staff and contractor confidentiality duties, backups, monitoring, and procedures for suspected incidents.

No website, email, cloud platform, payment system, AI tool, or method of electronic storage is completely secure. We cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of your Account credentials, using secure devices and networks, and notifying us promptly if you believe your Account or information has been compromised.

27Privacy Incidents

If we become aware of unauthorized access, loss, disclosure, or another privacy incident, we will investigate and take reasonable steps to contain, assess, document, and remediate it.

Where required by applicable law, we will notify affected individuals, privacy regulators, or other authorities and maintain required incident records.

28Your Privacy Rights

Depending on where you live and which laws apply, you may have the right to request access to personal information we hold about you; request correction of inaccurate information; withdraw consent; object to or restrict certain processing; request deletion; request portability; opt out of marketing; opt out of certain advertising-related sharing; or complain to a privacy regulator.

These rights are not absolute. We may be unable to delete or disclose information where retention or refusal is permitted or required for legal, contractual, security, fraud-prevention, confidentiality, privilege, Certification-integrity, or other lawful reasons.

We may need to verify your identity before processing a request. We will respond within the period required by applicable law and may charge a reasonable fee only where legally permitted.

29Access and Correction

You may request access to personal information under our custody or control and request correction where the information is inaccurate or incomplete.

We may refuse or limit access where permitted or required by law, including where disclosure would reveal another person's personal information, confidential commercial information, legally privileged information, security information, or information generated during a formal dispute or investigation.

If we decline a request, we will explain the reason where required by law.

You may update some Account and contact information directly through Kajabi or the applicable platform.

30Withdrawing Consent

You may withdraw consent to processing that relies on consent by contacting us or using the available preference or unsubscribe method.

Withdrawal does not affect processing that occurred lawfully before withdrawal.

We may continue to process information where needed to perform a contract, provide a requested service, collect amounts owed, preserve legal records, respond to disputes, protect security, enforce intellectual property, maintain Certification status, or comply with law.

If consent is necessary to provide an Offering, withdrawing it may mean that we cannot continue providing that Offering.

31European Economic Area and United Kingdom Rights

Where European Union, European Economic Area, or United Kingdom data-protection law applies, our processing may rely on consent, contractual necessity, steps requested before entering a contract, legal obligations, or legitimate interests such as operating and securing our business, preventing fraud, improving services, and protecting legal rights.

You may have rights of access, correction, erasure, restriction, objection, portability, withdrawal of consent, and complaint to a supervisory authority.

Where we rely on legitimate interests, you may request information about the relevant interest and object where applicable.

You may withdraw consent to marketing or non-essential cookies without affecting the lawfulness of prior processing.

32California and Other United States Privacy Rights

If a state privacy law applies to our activities, residents of that state may have rights to know or access categories and specific pieces of personal information; correct inaccurate information; request deletion; obtain portability; opt out of sale, sharing, or targeted advertising; limit certain uses of sensitive personal information; and receive equal service without unlawful discrimination for exercising a privacy right.

We do not sell customer lists for money. Advertising pixels and audience tools may nevertheless be treated as “sharing” or targeted advertising under certain laws.

Where required, you may exercise an opt-out through our cookie preference tool, an applicable browser preference signal, or by contacting us.

We may need to verify your identity and, where permitted, the authority of an authorized agent.

33Marketing Preferences

You may unsubscribe from marketing emails through the link in the message or by contacting us. You may opt out of marketing SMS by replying STOP or using the stated method.

Marketing opt-outs do not cancel a purchase, Account, Payment Plan, Subscription, Certification, or contractual relationship.

We may continue sending transactional and service messages reasonably necessary for a purchase, Account, Program, payment, security, Certification, or legal obligation.

34Testimonials, Stories, and Publicity

Purchasing or participating does not automatically authorize us to publicly use your identifiable name, face, voice, garden images, property, personal story, Certification submission, testimonial, or case study for marketing.

We will obtain separate permission before using identifiable participant material publicly, except where you have already deliberately posted the material publicly and our use is legally permitted.

You may withdraw future testimonial or publicity consent by contacting us, subject to materials already lawfully published, printed, distributed, or contractually committed before withdrawal.

35Public Posts and Community Information

Information you intentionally post in a public comment, public social-media channel, testimonial page, public event, or other publicly accessible area may be viewed, copied, shared, indexed, or stored by others.

Information posted in a private Community may be visible to other authorized members. We require members to respect privacy but cannot guarantee their conduct.

Do not post information you do not want others in the relevant audience to see.

36Children and Minors

Our paid Offerings, Accounts, Communities, live calls, AI Services, Certification, and experiential activities are intended for individuals who are at least eighteen years old and have reached the age of majority in their jurisdiction.

We do not knowingly collect personal information from a child for these services.

If you believe a minor has created an Account or provided personal information without appropriate authorization, contact us so we can investigate and take appropriate action.

37Third-Party Links and Embedded Content

Our Sites and Offerings may contain links to or embedded content from third-party websites and services, including YouTube, Vimeo, social-media platforms, payment providers, applications, and external resources.

Opening, playing, or interacting with third-party content may allow the third party to collect information about your device, Account, and activity.

We are not responsible for the privacy, security, content, or data practices of an independent third party. Review the third party's policies before providing information.

38Business Transfers
